PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS AND EXCLUSIONS THAT MIGHT APPLY TO YOU.
These terms and conditions apply to the purchase and sale of products and services from the motolab store (referred to as the “site”). By placing an order for such products and services, you agree to be bound by and accept these terms and conditions. If you do not agree to these terms and conditions, you should not obtain products or services from this site. These terms and conditions are subject to change by motolab (referred to as “us” or “we”) without prior written notice at any time, at our sole discretion. The latest version of the terms and conditions will be posted on this site, and you should review these terms and conditions prior to purchasing any products or services that are available through this site.

Order Acceptance and Cancellation

Private parties transact voluntarily, and we expect this right to be respected by both motolab and our customers. We therefore reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not payment has been received. Necessary refunds will be made promptly via the same method as payment.

Once an order has been placed, it may be canceled. However, if cancellation occurs after your shipment has been processed, our normal restocking fee of 20% or $15 per order, whichever is greater, will apply. Regardless of when an order is canceled, the amount refunded will reflect a 6.4% convenience fee since the payment processor's fee is not refunded to us.

We make every effort to maintain the availability of our site. However, should we experience technical difficulties, we are not responsible for orders that are not processed or accepted.

All orders are subject to review for suspicious activity. In some cases, these orders are stopped during a verification process. We want to ensure that the person placing the order is the person receiving the merchandise. If your order happens to be flagged for fraud then we will contact you via email. We apologize for this inconvenience, but we feel it is necessary to take these extra steps to protect our customers from fraud.

The billing name and/or billing address you provide must match what your credit card company has on file. We do not accept orders with a billing name and/or billing address mismatch. Orders with a billing name and/or billing address mismatch will be canceled.

A note to our customers in the United Kingdom: Beginning January 1, 2021, all orders to be shipped to the UK must contain products valued at £135 or more. If not, your order will be cancelled. As stated previously regarding any canceled order, the amount refunded will reflect a 6.2% convenience fee since the payment processor's fee is not refunded to us. We regret the inconvenience, and would certainly like to return to shipping orders with products valued at fewer than £135. However, the UK government now requires foreign merchants to collect and remit UK VAT for all shipments of lesser value. It is bad enough to be unpaid tax collectors for our own country's government. We draw the line at doing so for any other. If this new minimum order requirement is something you would also like to see change, please take it up with those in your government.

Payment Terms and Sales Taxes

Payment by check or credit card is accepted for domestic orders. Payment by credit card or Paypal is accepted for international orders.

Orders with payments that are made by check will be shipped after we receive payment and your check clears. Checks should be received within 10 business days from receipt of your order confirmation e-mail. We retain title to merchandise until it is fully paid for. If payment is not received after 2 weeks from the order date your requested items will be placed back in stock. We cannot guarantee that your items will be available if late payments are made.

We accept Visa, Master Card, American Express, Discover, JCB, and Diner's Club cards. You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

All payments must be in United States dollars. Current billing address and phone information must be included with every order. You agree to pay interest on all past-due sums at the highest rate allowed by law. We retain a security interest in the products and all proceeds thereof until the full purchase price therefore (including taxes and additional charges) has been paid.

We collect Iowa and Story County sales taxes for shipments with corresponding delivery addresses.

Shipping Policy

Domestic Shipments:

Orders typically ship the same business day if they are placed by 13:30 Central Standard Time. If this is important to you, please call us to confirm that will be the case. Likewise, please call if you wish to make any changes to your order before it has shipped. We will do the best we can to honor your request.

The shipping address you provide must be in a format that our shipping software will accept. If our shipping software does not accept the address as provided, we will attempt to contact you to make the required adjustments. If we are unable to make the necessary adjustments, we will cancel your order and refund your payment.

All parts are in stock unless otherwise noted. Best efforts are made to maintain accurate stock levels, but mistakes and glitches do happen, so there is a small chance that shipment of a product could be substantially delayed or even cancelled. In that event, you have our apologies, and you agree that motolab will not be held liable for any possible impact of such a circumstance. If the aforementioned occurs, we will contact you with your options, which may include: shipping the parts that are in stock and the rest later at our expense, holding your order until it is complete, canceling the parts which are out of stock, or canceling the entire order. If you choose cancellation we will waive our normal 6.2% cancellation fee. If we are unable to contact you, we will ship what we have available and ship the remainder at our expense via the service of our choice if/when it becomes available.

Please note that expedited shipping may not be available for all orders, such as those containing liquids or hazardous materials.

If a shipment is refused, you are liable for payment of outbound and return shipping charges, plus our usual restocking fee. Orders which are returned as undeliverable will be treated in the same manner as orders which are refused unless the customer elects to have the shipment resent to a new address, in which case the customer is liable for payment of the outstanding shipping charge.

We require a signature for delivery of all domestic orders valued at $500 or more, and the fee charged for this service will be added to your order during checkout. When no signature is required for an order, you agree to bear the risk of loss for such orders. We will not refund any lost or stolen orders if the carrier confirms delivery to the address provided. Please call before placing your order to add the signature required option if you have concerns about your delivery location’s security.

If an order is determined to require oversize packaging at the time of shipping or there is any other shipping issue, you will be contacted for payment of any additional freight charges prior to your order being shipped.

International Shipments:

USPS First Class Mail International shipping service is offered as an economical option for light shipments of fewer than four line items. As USPS First Class International service does not include detailed tracking information, motolab cannot be held responsible for lost or misdirected shipments sent via that service (however shipments are insured against damage) so the customer must agree to assume this risk if selecting the USPS First Class International shipment method.

Refunds will not be issued for lost or stolen orders sent via any shipping method if the carrier confirms delivery to the address provided. We will only issue refunds for insured packages when the insurance provider’s requirements are met to their satisfaction and the insurance provider has therefore chosen to honor the claim.

If an order is determined to require oversize packaging at the time of shipping or there is any other shipping issue, you will be contacted for payment of any additional freight charges prior to your order being shipped.

International shipments may incur additional charges from the recipient country such as duty and/or brokerage fees. motolab does not collect these amounts at the time of purchase, and the customer is solely responsible for their payment. The aforementioned fees do not constitute justifiable cause for refusing shipments. If a shipment is refused, you are liable for payment of outbound and return shipping charges, plus our usual restocking fee.

Please note that expedited shipping may not be available for all orders, such as those containing liquids or hazardous materials. Additionally, some products are completely prohibited in international shipments. If your order contains such a product, we will contact you with your options as stated in the preceding paragraph.

Return Policy

Domestic orders:

We understand that mistakes happen. To help prevent them, please feel free to call us prior to placing your order so that we can help make sure you’re getting the correct parts.

Returns must include a Return Merchandise Authorization number provided by motolab. Please e-mail customerservice@store.moto-lab.com to initiate the return process. No returns will be accepted if they are shipped more than fourteen days after the original delivery date and/or without a valid clearly legible RMA number on the outside of the package. Any part which has been installed or shows signs of attempting to be installed on a vehicle is non-returnable. Electrical parts are not returnable.

a. If you ordered the wrong part or changed your mind, returns are accepted if the merchandise and its packaging is in new, unused, undamaged, and unopened (if applicable) condition. We are not looking to profit from your mistake, only to recoup any costs we incur as a result of your return. Your refund will therefore reflect a 20% or $15 restocking fee per returned order, whichever is greater. You are responsible for return shipping. We recommend shipping via a service that includes tracking and insurance. Please retain your return tracking information. motolab is not responsible for packages lost during return shipment. All shipments must be prepaid; packages shipped COD will be rejected. International shipments should be marked as a "Merchandise Return" on the customs forms and sent with a carrier that does not levy brokerage fees. The customer is responsible for any applicable brokerage or customs charges. Any items shipped COD or entailing any type of fee that would be charged to motolab upon delivery will be rejected. Please do not tape anything to the original product packaging. Place all merchandise in a shipping box with plenty of packing material; you may use the original shipping container and material. However, please do not use the manufacturer's product box as the shipping container. It will arrive damaged and our returns department will reject it.

b. If we sent you other than what you ordered, the merchandise and its packaging must be in new, unused, undamaged, and unopened (if applicable) condition. Return it along with its original packaging. We will provide a return shipping label and either issue a refund in the amount of the cost of the part or send a replacement at no cost to you. If, however, the returned item is not found to be other than what you ordered, we will refund you the purchase price of the part minus a restocking fee and the return shipping cost. If we agree that the item is not what you ordered, then we will refund the purchase price of the item as well as the return shipping cost (if applicable.)

c. If an item is damaged in transit, we will file an insurance claim with the carrier or insurance provider (if different.) We will only issue refunds for insured packages when the insurance provider’s requirements are met to their satisfaction and the insurance provider has therefore chosen to honor the claim.

d. If an item appears to be defective, please return it with its original packaging via UPS Ground, USPS First Class Mail, or USPS Parcel Select. If, upon inspection, we determine the item to indeed be defective we will either issue a refund of the purchase price of the part or send a replacement at no cost to you, and refund your shipping cost.

Refunds will be issued in the same format in which your payment was made. A 4.5% convenience fee will be deducted since payment processors are no longer refunding their processing fees. Please note that (if payment was via credit card), depending on your credit card company, it may take an additional 2-10 business days after your credit is applied for it to be posted to your account. You will receive a confirmation e-mail to inform you that your refund has been issued.

Privacy and Customer Information

motolab respects the privacy of its customers. We never have, and never will, sell, rent, loan, give away, or otherwise share the name and address of anyone who does business with us. We promise to only use the information you provide to process orders or address issues affecting the same.

Sometimes cookies are used for site functionality. They are used to aid navigation, and to keep track of the contents of your shopping cart. If you log in to an account, your logged-in status is recorded in a cookie. You can turn off cookies by blocking them in your browser Privacy settings. If you turn off cookies, you will be unable to place orders or benefit from the other features that use them. Please note that Stripe is processing motolab credit card purchases and may choose to collect user data via cookies or other means. At any time you may update your customer account information (if you create an account) by logging in and editing the information at https://store.moto-lab.com/user. Here you may update your password, e-mail address, billing address, or shipping address.

motolab® is our registered trademark. Otherwise, all trademarks and registered trademarks relating to products and services available through our site are the sole property of their respective owners.

Site Security

We maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of information transmitted to us. To guard your information delivered to us electronically, our site uses Secure Sockets Layer/Transport Layer Security (SSL/TLS.) To prevent your sensitive data from ever reaching our servers, we have chosen tokenized credit card processing or offsite payment at Paypal. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your information, we cannot guarantee or warrant the security of any information you transmit to or from our Site or anyone else's, and you do so at your own risk.

Disclaimer and Limitation of Liability

Our responsibility for defects relating to the products and services available on our site is limited to the procedures described in our return policy set forth below. ALL PRODUCTS AND SERVICES AVAILABLE ON THIS SITE ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT. Force Majeure

In addition to any excuse provided by applicable law, we shall be excused from liability for non-delivery or delay in delivery of products and service available through our site arising from any event beyond our reasonable control, whether or not foreseeable by either party, including but not limited to, labor disturbance, war, fire, accident, adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above.

Entire Agreement

These terms and conditions constitute the entire agreement and understanding between us concerning the subject matter hereof and supersedes all prior agreements and understandings of the parties with respect thereto. These terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s). Any attempt to alter, supplement or amend this document or to enter an order for products or services which are subject to additional or altered terms and conditions shall be null and void, unless otherwise agreed to in a written agreement signed by you and us. To the extent that anything in or associated with this site is in conflict or inconsistent with these terms and conditions, these terms and conditions shall take precedence.
